This was swift: The Philippine authorities have already surrendered former President Duterte to the ICC in The Hague to face trial for the alleged crimes against humanity of murder. The man who said, ‘my job is to kill’ and who oversaw the shootings to death of victims – including children – as part of a deliberate, widespread and well-organized campaign of state-sanctioned killings the man who once was all-powerful, so much so that he could openly threaten anyone who questioned his war on drugs; This man is now on his way to the Hague and an ICC jail. To all those in power now who think they are above the law - think twice, think carefully. Time will come: you will not enjoy impunity forever, no matter how powerful you are now.

We are extremely alarmed by the latest information we have received regarding the whereabouts of Dr. Hussam Abu Safiyyah, director of Kamal Adwan Hospital. He should now be considered as victim of enforced disappeared, and as such at great risk of torture and ill-treatment. Israel authorities must urgently disclose the location of Dr. Hussam Abu Safiyyah. Dr. Abu Safiyyah was reportedly arrested on December 27, 2024, when IDF forces raided Kamal Adwan Hospital. Video footage from that day shows the senior doctor walking toward an IDF armored vehicle before being taken for questioning. Following the incident, an IDF spokesperson confirmed his arrest and stated that he had been transferred for interrogation. However, since then, no further information has been provided about his whereabouts. But on Thursday January 1st, the Israeli military informed Physicians for Human Rights that they have no record of Dr. Abu Safiyyah’s detention. This response came after PHRI, acting on behalf of Dr. Abu Safiyyah’s family requested information to facilitate a lawyer’s visit on January 2. In its response to PHRI’s inquiry, the military stated: "Following your inquiry, we would like to inform you that a review has found no indication of the arrest or detention of the individual in question." In light of this denial, PHRI has now filed a petition with the Israeli High Court of Justice (HCJ) on Thursday, demanding immediate disclosure of Dr. Abu Safiyyah’s location. Since October 2023, Israel has detained hundreds of Palestinian healthcare workers from Gaza without charge or trial. Health workers have been subjected to torture and other ill-treatment and been held in incommunicado detention.

So in a new twist, the IDF now acknowledges detaining Dr. Hussam Abu Safiyyah, director of Kamal Adwan Hospital, insisting he is investigated for links with Hamas. Please join @amnesty in calling for Dr. Hussam to be granted access to a lawyer and his family, and for his release. A few facts on Dr. Hussam Kamal Adwan hospital was raided previously in December 2023, with several medical staff arbitrarily detained and disappeared. Back then, Dr. Hussam was interrogated briefly. At the time, not a single Israeli source accused Dr. Hussam of anything. After the initial raid on Kamal Adwan, which put the hospital out of service, Dr. Hussam and other staff managed, with the support of international organizations, to get the hospital to function again. It played an indispensable role in treating children suffering from malnutrition and dehydration-related issues. The hospital also received those wounded from a series of Israeli attacks on starving people as they waited for flour trucks, known as flour massacres. Between the months of February 2024-September 2024, Dr. Abu Safiya was the go-to source for human rights and humanitarian organizations investigating the situation of the healthcare sector in north Gaza and the impact of the mixture of disease and hunger on children in particular, providing accurate, non-sensationalist and credible information, coordinating with international health organisations , providing media briefings, all whilst obviously working as a dedicated pediatrician. The only time even the Israeli army brought up the Hamas link was following his disappearance last Friday. They told journalists this morning 03/01 that "Hussam Abu Sufaya was apprehended for suspected involvement in terrorist activities, and for holding a rank in the Hamas terror organization, while hundreds of Hamas and Islamic Jihad terrorists were hiding inside the Kamal Adwan Hospital under his management. He is currently being investigated by Israeli security forces." Dr. Abu Safiya’s unlawful detention is emblematic of the broader attacks on the healthcare sector in Gaza and Israel’s attempts to annihilate it. It is part and parcel of Israel's genocidal intent and genocidal acts - meant to inflict conditions of life CALCULATED TO BRING ABOUT DESTRUCTION OF PALESTINIANS. Dr. Abu Safiya has been acting as a leading voice for the healthcare sector in the north of Gaza since October 2024 and refusing to abandon the hospital and his patients. He has stood against Israel's genocidal act and his arrest along with that of 100s of Palestinian medical staff further provides evidence of genocidal intent. None of the medical staff abducted by Israeli forces since November 2023 from Gaza during raids on hospitals and clinics has been charged or put before a trial; those released after enduring unimaginable torture were never charged and did not stand trial. Those still detained remain held without charges or trial under inhumane conditions and at risk of torture.

Gheed Kassem, Dr. Hussam Abu Safiya’s lawyer, posted seven hours ago a horrific update on her Facebook accounts regarding the abducted doctor. Here is a translation: Dr. Hussam Abu Safia is not well. I visited him last on July 9, 2025. What I saw was heartbreaking. Since his detention began, he has lost more than 40 kilograms—over a third of his body weight. He entered prison weighing 100 kilograms. Today, he weighs no more than 60. On June 24, 2025, Dr. Hussam was subjected to a targeted and brutal assault. Soldiers stormed Room 1, Section 24 of Ofer Prison, where he was held, and beat him mercilessly for 30 minutes. His rib cage was struck repeatedly. He sustained severe bruises across his face, head, back, and neck. He asked for medical care—basic tests, treatment, and access to a cardiologist. He was referred, but the request was later denied. Dr. Hussam suffers from irregular heartbeat, yet even this urgent condition is being ignored. The glasses his lawyer recently provided him were also broken during the assault. He remains underground, in isolation, without sunlight. He is still wearing his winter clothes in the middle of summer, under conditions of starvation, torture, and neglect. Dr. Hussam Abu Safia is not the only one. All Palestinian prisoners are enduring the same inhumane conditions.

EU Israel agreement The EU’s refusal to suspend its agreement with Israel is a cruel and unlawful betrayal – of the European project and vision, predicated on upholding international law and fighting authoritarian practices, of the European Union’s own rules and of the human rights of Palestinians.   This vote will be remembered as one of the most disgraceful moments in the EU’s history. European leaders had the opportunity to take a principled stand against Israel’s crimes, but instead gave it a greenlight to continue its genocide in Gaza, its unlawful occupation of the whole Occupied Palestinian Territory (OPT), and its system of apartheid against Palestinians.   The EU’s own review has clearly found that Israel is violating its human rights obligations under the terms of the Association Agreement. Yet, instead of taking measures to stop it and prevent their own complicity, member states chose to maintain a preferential trade deal over respecting their international obligations and saving Palestinian lives.   This is more than political cowardice. Every time the EU fails to act, the risk of complicity in Israel’s actions grows. This sends an extremely dangerous message to perpetrators of atrocity crimes that they will not only go unpunished but be rewarded.   Victims are entitled to far more than empty words. Member states must now take matters into their own hands and unilaterally suspend all forms of cooperation with Israel that may contribute to its grave violations of international law, including a comprehensive embargo on the export of arms and surveillance equipment and related technology, and a total ban on trade with and investment in Israel’s illegal settlements in the OPT.

Publicly condemn the use of sanctions to undermine the ICC and express strong, unconditional commitment to the ICC and its critical global mandate; to the UN Special Procedures and all those cooperating with the ICC Pass national laws that shield individuals and companies from the threat of US sanction laws. Fully cooperate with the Court, including by arresting and transferring individuals subject to ICC arrest warrants.    Call on the United States to cease any efforts to undermine the court’s independence and essential work, while encouraging the United States to join the ICC and fully support victims’ access to justice;   Harmonise domestic legislations with the Rome Statute, ratifying and implementing the Agreement on the Privileges and Immunities of the International Criminal Court (APIC), and signing all relevant cooperation agreements with the ICC (for example, on the protection of witnesses and victims; the release of persons, including interim release; and the enforcement of sentences);  Adopt and/or implement national and regional blocking statutes, such as the European Union (EU) blocking statute, that aims to shield European operators from the effects of extraterritorial sanctions.  Blocking statutes and similar instruments can provide the Court and its partners with essential protection and send a powerful message that ICC member countries will not tolerate efforts to undermine the Court;    Adopt any other protective measures at the domestic, regional or international level, and engage with domestic and regional service providers to ensure that they will continue working with the Court.

Yet again, the Palestinians of Gaza are denied access to humanitarian aid, following Israel's decision to block aid going into Gaza - a move which violates international law, amounts to collective punishment, and continues Israel's well-evidenced policies and actions of inflicting conditions of life calculated to bring about the physical destruction of Palestinians of Gaza. What does international law tell us? As the occupying power, Israel has an obligation to ensure the population of Gaza has adequate access to food, essential supplies, medicine and medical care. Article 55 of the Fourth Geneva Convention states: “To the fullest extent of the means available to it, the Occupying Power has the duty of ensuring the food and medical supplies of the population; it should, in particular, bring in the necessary foodstuffs, medical stores and other articles if the resources of the occupied territory are inadequate.” Article 59 is particularly relevant to the situation in Gaza stipulates: “If the whole or part of the population of an occupied territory is inadequately supplied, the Occupying Power shall agree to relief schemes on behalf of the said population, and shall facilitate them by all the means at its disposal.” The obligation of the occupying power to agree to allow humanitarian assistance to enter and be distributed throughout the occupied territory is unconditional. And the occupying power must not only agree to such relief schemes but also “‘facilitate’ them by all the means at its disposal.” The obligation to facilitate relief schemes means that “[t]he occupation authorities must therefore co-operate wholeheartedly in the rapid and scrupulous execution of these schemes. Under the Rome Statute, intentionally using starvation of civilians as a method of warfare, by depriving them of objects indispensable to their survival, including wilfully impeding relief supplies as provided for under the Geneva Conventions, constitutes a war crime. The act of deliberately inflicting conditions of life calculated to bring about its physical destruction is prohibited under Article II(c) of the Genocide Convention. Switzerland cancelled a conference by the High Contracting Parties (HCP) to the Geneva Conventions, requested by a 2024 UN General Assembly resolution, on the implementation of the Fourth Geneva Convention in the Occupied Palestinian Territory. But let it be stated loudly: the draft declaration circulated by #Switzerland among participating states after a non-transparent process failed to meet basic demands around the respect for international humanitarian law and shamefully failed to acknowledge the July 2024 Advisory Opinion of the International Court of Justice (ICJ) declaring Israel’s occupation of Gaza and the West Bank, including East Jerusalem, unlawful. States yet again failed to fulfil their mandate to focus on enforcement of the Geneva Conventions in the Occupied Palestinian Territory (OPT). This is another blow to international law and a betrayal of victims of unlawful killings and other serious violations of international humanitarian law in the OPT and in Israel. By failing to uphold their legal obligation to ensure respect for the Fourth Geneva Convention states have put political expediency above the legal obligations to protect civilians in war time, even in the face of Israel’s relentless grave breaches of the Convention and other serious violations of international humanitarian law across the OPT and the genocide in Gaza. Instead of showing their commitment to upholding human rights and international law, states have callously squandered a crucial opportunity to agree key measures to enforce the application of international humanitarian law in the OPT demonstrating a chilling indifference to the fate of all civilians, and particularly of Palestinians, as Israel has once again blocked the entry of all humanitarian aid to Gaza and is forcibly displacing thousands of Palestinians in the occupied West Bank. This failure is a particular indictment of all European States that have been clamouring their commitment to international law and the rule-based order for several weeks now, in the context of the Ukrainian conflict, only to yet again fail to walk the talk, further devastating whatever remained of international and universal values. Many thanks to PM @sanchezcastejon for the meeting to discuss @amnesty report on Israel genocide of Palestinians in Gaza and to exchange on the paths to justice and accountability. We are grateful to the Spanish government for its principled leadership at a time when so many governments, including in Europe, are prepared to ignore the carnage in Gaza and Israel’s repeated violations of international law.

Le he trasladado que España es un país comprometido con la legalidad internacional y el respeto a los derechos humanos. Los defenderemos siempre y en cualquier lugar del mundo, ya sea en Gaza, Líbano o Siria.
