🚨 New NICE data reveals a stark reality—nearly 99% of the 18.6M illegal aliens in the U.S. continue to roam free, even 120 days into the Trump administration. Despite a 21% increase in ICE detainees. Only 1.26% are detained or tracked (49,005 in facilities, 184,899 enrolled in GPS monitoring). Even if Congress quadrupled ICE detention beds to 200k via reconciliation, it would only raise that to 2.1%.
Todd Lyons is doing all he can, but resource constraints are the core issue. Bafflingly, with WH approval, House Republicans chose to go $30B below the $110B ICE could have received—resulting in a 100k bed total.
When the money hits, WH/DHS must allow Todd and co. to go beyond criminal aliens—600k are roaming free—but the have a non-detained docket nearing 8M, and 1.4M final orders of removal. Final orders must be prioritized alongside criminals, setting a 2M mass deportation floor.

IMPORTANT: Despite some media reports based on targeted leaks, Laken Riley’s killer was NOT released due to a lack of detention space or facilities being overcrowded.
In FY2022, there were 34,000 detention beds made available by Congress per day (this is known as average daily population or ADP). In their budget request for that year, the Biden Administration only asked for 25,000. They told Congress that funding an ADP of 25,000 “maintains ICE’s ability to effectively manage its current detainee population flows. ICE retains the ability to apprehend, detain and remove noncitizens that present a threat to national security, border security, and public safety.” So in response to this utter nonsense, Congress actually gave them MORE detention beds than requested for the year, and Mayorkas refused to comply.
In the month Jose Antonio Ibarra was released (Sept 2022) the ADP in detention facilities was 25,863 (this is reflected in an ICE chart below).
This means that there were around 8,000 available beds to DETAIN and REMOVE this eventual killer. Instead, he was RELEASED, joining millions of illegal aliens freely roaming American communities and then committing a heinous, preventable crime.
Also, while the deeply-flawed Senate bill being hailed as a solution to the crisis contains more detention beds per day (50,000 for the next 3 years), there is no requirement that they must be filled, and the bed total should be even HIGHER.
Detention is a critical immigration enforcement function and it must be EXPANDED on a larger scale and properly used.

Based on media reports, President Biden is slated to issue a political gimmick Executive Order today to “address” a border crisis HE created.
Remember President Obama’s DHS Secretary Jeh Johnson? He once stated that 1,000 apprehensions a day “overwhelms the system.”
However, the EO we expect to see today is likely to trigger enforcement actions once a loophole-laden apprehension metric exceeds 2,500 in a day between ports of entry—an amount that green lights nearly 1 MILLION apprehensions per year.
This number is sure to be loaded with exemptions including unaccompanied alien children, which will enable human trafficking and allow teenage gang members to continue to enter.
Even worse, the number won’t include any of the roughly 70,000 monthly encounters allowed through Biden's unlawful CBP One App, CHNV, and other mass parole programs.
So Biden is about to officially legitimize crisis levels of illegal immigration through a variety of avenues (around 2 MILLION a year), while gutting interior enforcement by refusing to arrest, detain, and deport illegal aliens in accordance with the law (the non-detained docket is approaching 7 MILLION, while hundreds of thousands are receiving prosecutorial discretion AMNESTY).

Check out the tax returns for one of these popup NGO shells, the Climate United Fund which got the biggest nonprofit grant in history out of Biden’s massive climate slush funds.
Kamala Harris and Biden’s EPA chief Michael Regan gave $7 billion total to the suddenly created Climate United Fund in April 2024 after it launched just five months earlier in November 30, 2022 when Its tax returns show it started with a tiny $547K in revs.
But it spent a massive $451K of that $547k in just two months in 2023, a quarter of that on legal fees and the majority $323K mysteriously blown on no one knows what because its tax returns don’t say.
It has no stipulated plans for how it will spend your $7B in tax $$, just ephemeral solar projects in Idaho, Arkansas, and Oregon that amount to only about $50M total, a fraction of the $7B. It also gave money out of that $7b to Power Forward Communities linked to Stacey Abrams.
It has little to no details on how much its officers get paid that you typically see on NGO 990s, in fact virtually no details, red flags that it’s a shell.
It supposedly is a partnership betw Dem insiders at investment firm Calvert Impact Capital, Community Preservation Corp. and a group called “Self-Help” (irony noted).
Beth Bafford is its CEO, a former “special assistant” in Obama’s OMB and a regional field director for the Obama Campaign.
As we tweeted about a month ago, it has ties to Democratic Party of California chairman and California State Treasurer Phil Angelides, Obama’s Transportation Secretary Anthony Foxx, United Farm Workers of America co-founder Dolores Huerta and Patrice Willoughby of the Congressional Black Caucus.

The ICE non-detained docket is now larger than the population of 35 U.S. states.
NEW: Per multiple federal sources, ICE’s non-detained docket has exploded to 7.4 million cases, more than doubling the Trump years, and it’s on pace to hit 8 million by end of year. Each ICE officer now has to manage an average of 7,000 cases each, an impossible task given the agency’s current staffing levels. ICE currently only has roughly 6,000 deportation officers nationwide, and not all of them work on the non-detained docket.
The non-detained docket means not in ICE detention. It is made up of migrants who have crossed the border illegally and have been released into the U.S. with pending immigration cases/future court dates, as well as illegal immigrants who have already been ordered deported by an immigration judge, but are still in the country.
The non-detained docket has added more than 1 million cases since October 1st, largely due to mass catch and release policies.
Importantly, these numbers do not include the nearly 1.9 million recorded gotaways that have entered the US during the Biden administration, as they have had no contact with DHS - yet overstreched ICE officers are also responsible for tracking down and removing this population as well.
ICE sources tell FOX it is simply impossible to do with current staffing levels compared to the numbers that have been coming across the border in recent years, and they are in desperate need of additional manpower and resources.

On Day One, President Trump signed Executive Order 14159, revoking all Biden-era immigration guidance and making it crystal clear: ICE is supposed to go after all illegal aliens, not just a select few. You know… this thing called mass deportation.
But the FY26 DHS budget request sent to Capitol Hill didn’t reflect that. It quietly reverted to old language about “prioritizing” illegal aliens, mainly criminals. That’s the same narrow enforcement approach Trump explicitly rejected.
So, in a key ICE section (ERO), the budget fails to cite EO 14159, despite it being the controlling enforcement policy. Instead, it hints at an approach that mirrors the Mayorkas memo that Trump’s EO was meant to erase.
What’s crazy here is that Trump’s first-term DHS budgets *always* cited EO 13768, which was issued out the gate and carried the same directive—deport any illegal alien, period.
Again, to recap:
The Trump Administration didn’t cite EO 14159 in its own DHS budget request, which served as the blueprint for this bill.
The House Appropriations Committee didn’t just nod along with that blueprint detail… they made it worse at the last minute, on paper.
With a cash infusion on the horizon, it’s time for everyone to get back on the proper course.
Let us make it clear: Full enforcement isn’t optional. It’s the mandate.
