I mean, if you look and look at it from a logical pov.
Max is told to give the position back by the FIA via his race engineer. He is told to do it strategically and as such slows down to let Hamilton pass. Hamilton does not pass, max then slows down even more, Hamilton does not pass. Max then slows down EVEN more at that moment Hamilton goes for an overtake.
It’s legit just miscommunication and the he fault of the FIA telling 1 team to give the position back and not telling the other team they were doing it.
