Probably moot by now, but worth saying anyway: I don’t believe that the House Republicans had authority to order DPS to surveil the Democrats 24/7 as a way to prevent a quorum break. House members have the constitutional power to break quorum. The remaining legislators have the constitutional power to forcibly restore quorum (send DPS to arrest you!). But no one has the power to prevent a quorum break. Because if they did, there wouldn’t be a constitutional power to break.
A look at the rules leads to the same conclusion. House Rule 5, section 8 (“Securing a Quorum”) provides that a group of House members can move for a “call of House” to secure a quorum, and condition the release of members from the chamber on pretty much anything they want. But once a quorum is established, there’s no basis to detain anyone. Moreover, the same Rule provides that under a “call of the House” the House cannot recess, it can only adjourn. Once it has adjourned… there is no quorum to be established.
