On the other hand, he was not convicted of sexual assault; only the charges of unlawful entry and making threats were applied. He was sentenced to 6 months in prison, with a 2-year suspension. She felt guilty because she had recommended the job to her older sister. After losing both daughters to suicide, their father suffered a stroke due to shock and passed away. The mother grieved deeply over the suicides of her daughters and the death of her husband. She was also enraged that none of the men who had raped her daughter faced any punishment. In 2014, she filed a civil lawsuit against the twelve men who committed sexual crimes against her daughter. However, because three years had passed since the crimes occurred, she lost all of the lawsuits. As a result, the perpetrators faced no consequences. Instead, they sued the mother for holding solo protests with placards that read “Rapist! Murderer!” (In South Korea, there is a law called “Defamation by Fact,” which allows individuals to sue for defamation even if the statements made are true.) Several of the perpetrators filed lawsuits against her and won. Since they won all three trials, she is now required to pay them compensation ranging from 3 million to 5 million KRW per person. Other perpetrators also filed lawsuits against her. In one trial, the court ruled that she must pay them 10 million KRW in damages and refrain from posting anything about them online in the future. If she violates this ruling and posts about them online again, she will have to pay them an additional 1 million KRW per post (this ruling is not yet finalized; if she appeals, a second trial will take place). I feel deep sorrow for the woman who was raped and driven to suicide, for her younger sister who suffered from guilt and also chose suicide, and for their father who died from shock after losing his daughters. This decision was made despite Jo Doo-soon insulting and sexually harassing the victim in court instead of showing remorse. Jo Doo-soon had a history of violent crimes. He had previously assaulted and kidnapped a 19-year-old woman, for which he served three years in prison, and killed a homeless person, receiving a two-year sentence. In total, he committed 18 criminal offenses. Jo Doo-soon was released from prison in 2020 and moved to Ansan, the neighborhood where the victim’s family lived. The victim, fearing for her safety and feeling guilty toward the local residents, was forced to move away. Jo Doo-soon still shows no remorse for his actions. Upon his release, he was escorted by police for protection and currently receives basic pension benefits, housing subsidies, and living allowances from the government. South Korea is harsh on rape victims but lenient toward rapists. If a man drinks alcohol and rapes a woman, his sentence is reduced, but if a woman is raped while intoxicated, she is blamed. (In South Korea, the crime of rape is defined as a case involving “violence and threats to a level that a woman cannot resist.” If a woman is intoxicated, it is presumed that she did not actively resist, and therefore, legally, the crime of rape is not established.) Korea needs to be harsher on rapists.

These cases show why Korea's rape report rate is significantly low. (In 2023, there were 185,786 cases of sexual assault. However, the number of sexual assault cases increases eight-fold when including unreported sexual assault.) Several men who participated in Club Burning Sun's sex crimes also took naked photos of them after raping the women so they could not report. The rapists threatened that they could not let the victim out without taking a picture, and the women eventually had to take a picture in the pose demanded by the rapists. But the reality in Korea is harsh on women. In Korea, the standard for allowing rape is very strict. Rape can only be recognized if it is accompanied by assault and intimidation that ‘a level that a woman cannot resist’. It is also extremely rare for women to sue men for false accusations. When analyzing sex crime cases from 2017 to 2018, the number of suspects who were falsely accused of sexual assault crimes was only 0.78%. Of these 84.1% are not charged. Below is a description of the Miryang group rape. 44 male high school students gang-raped a 13-year-old girl. However, this resistance is part of the victim’s attempt to escape the situation and is not a crime. Korea’s self-defense laws have remained the same since the 1960s. (Although the wording has been slightly updated in the 2020s, the content remains unchanged.) There is a need to revise the law so that victims can actively resist the perpetrators.

South Korea will do anything to protect rapists. Forty-four men who gang-raped a 13-year-old girl over the course of a year faced no legal punishment. However, a YouTuber who exposed the identities of the perpetrators was sentenced to 5 years in prison.
A woman who was gang-raped and her younger sister, who suffered from guilt, both took their own lives. Later, their mother was sued by the rapists and is now required to compensate them financially. In 2004, a woman worked as a film extra. While working, she was raped by four men and sexually harassed by eight others. Afterward, she began exhibiting strange behaviors at home, such as mumbling to herself or breaking objects. Her family took her to the hospital, where they discovered that she had been raped by multiple men. She received treatment at the hospital and filed charges against the perpetrators. However, the men threatened her, saying things like, “I will burn down your house” and “I will kill your entire family.” Out of fear, she withdrew her charges. On August 18, 2009, she jumped from the 18th floor of an apartment building and died by suicide. She felt guilty because she had recommended the job to her older sister. After losing both daughters to suicide, their father suffered a stroke due to shock and passed away. The mother grieved deeply over the suicides of her daughters and the death of her husband. She was also enraged that none of the men who had raped her daughter faced any punishment. In 2014, she filed a civil lawsuit against the twelve men who committed sexual crimes against her daughter. However, because three years had passed since the crimes occurred, she lost all of the lawsuits. As a result, the perpetrators faced no consequences. Instead, they sued the mother for holding solo protests with placards that read “Rapist! Murderer!” (In South Korea, there is a law called “Defamation by Fact,” which allows individuals to sue for defamation even if the statements made are true.) Several of the perpetrators filed lawsuits against her and won. Since they won all three trials, she is now required to pay them compensation ranging from 3 million to 5 million KRW per person. Other perpetrators also filed lawsuits against her. In one trial, the court ruled that she must pay them 10 million KRW in damages and refrain from posting anything about them online in the future. If she violates this ruling and posts about them online again, she will have to pay them an additional 1 million KRW per post (this ruling is not yet finalized; if she appeals, a second trial will take place).
