yea as a general legal principle i don't think "oops i spent it already" tends to work but i am not a lawyer
US businesses all bore the *legal* incidence of the tariffs (regardless of who bore the actual *economic* incidence), so if this is the Admin strategy for complying w/ a court-mandated refund then good chance they'll end up having to pay it again to businesses, doubling the cost.
