🚨UPDATE: Outspoken but not inaccurate: medical tribunal makes no finding of misinformation by Dr. Hodkinson Dr. Roger Hodkinson will retain his medical license following a hearing before the College of Physicians and Surgeons of Alberta (CPSA). Calgary: Dr. Roger Hodkinson will retain his medical license following a hearing before the College of Physicians and Surgeons of Alberta (CPSA), which resulted in minimal sanctions against the outspoken pathologist. Dr. Hodkinson faced allegations of unprofessional conduct regarding 17 public statements made in November 2020 and April 2021. His remarks were critical of public health officials and presented an alternative perspective on COVID-19, including the efficacy of masking and vaccines. Initially, the CPSA alleged that his statements were inaccurate or misleading. However, following negotiations with lawyers for The Democracy Fund, the CPSA limited its claims to arguing that Dr. Hodkinson’s comments violated the ethical code and extended beyond the scope of a general pathologist. While Dr. Hodkinson did not concede that any of his statements were false, he acknowledged that his criticisms of other physicians technically breached the Code of Ethics and Professionalism. He also admitted that he should have clarified that his views were outside the scope of a general pathologist. The case was resolved through a joint submission, resulting in Dr. Hodkinson receiving a caution and being required to complete an online course on influence and advocacy. @AlanHonner was retained by TDF to represent Dr. Hodkinson. “Dr. Hodkinson acknowledged that he could have used more measured language when critiquing physicians with whom he disagrees," said Honner. "However, he did not concede that any of his statements were misinformation, nor did the tribunal make such a determination." Dr. Hodkinson now joins other prominent health professionals, such as Dr. Jordan Peterson and Dr. Kulvinder Kaur Gill, who have been cautioned by their respective regulatory bodies for making public comments that diverge from the official narrative. Last year, Alberta Premier Danielle Smith pledged to review the province’s regulated professions to ensure that the freedom of speech of professionals is adequately protected. She also committed to legislative changes to ensure that professionals are regulated based on competence and conduct rather than speech. Dr. Hodkinson strongly supports safeguarding free speech for health professionals. “The essence of progress in all scientific matters, including medicine, is debate regarding scientific findings,” he stated. Dr. Hodkinson earned his medical degree from Cambridge University and completed his pathology residency in Vancouver. He has served as an assistant clinical professor at the University of Alberta and as past Chair of the Royal College specialty examination in pathology. With several publications and awards to his name, he had until now maintained a spotless disciplinary record over his 50-year career. TORONTO: The Democracy Fund (TDF) has secured a pivotal victory for Ontario’s Amish community, with the Crown withdrawing all Quarantine Act tickets against a group of Grey County Amish clients. The decision to withdraw concludes nearly six months of legal efforts, culminating in successful negotiations between TDF lawyers and Crown prosecutors. Withdrawing the tickets in Lambton County Court, the Crown cited “no reasonable prospect of conviction." Senior Litigation Counsel Adam Blake-Gallipeau represented the Amish families in court during the withdrawal. The Amish rely on horse-and-buggy travel and lack familiarity with modern legal systems. After crossing the border during the COVID-19 pandemic, they were hit with thousands of dollars in Quarantine Act fines tied to the ArriveCan app and PCR testing. Among the clients are families with sick and disabled children. These families rely on traditional farming and often pass their property to descendants - something that was threatened by liens registered against their property after the fines went unpaid — a threat now alleviated by this win. Due to TDF’s advocacy, their cases were reopened in early February, paving the way for today’s resolution. “This is a victory for fairness,” said Blake-Gallipeau. “The Crown’s withdrawal is significant. 🚨 James Bauder, criminally charged for peaceful protest, files U.S. asylum claim Freedom Convoy participant, James Bauder, is seeking political asylum in the U.S. The Canadian Court issued a bench warrant for his arrest. Ottawa— TDF-funded lawyers Lawrence Greenspon and Eric Granger appeared on behalf of Freedom Convoy protester, James Bauder, in Ottawa court on August 27. Justice Phillips had previously ordered Bauder's attendance to explain his intentions regarding his upcoming criminal trial. Bauder is charged with 5 criminal offences arising from his peaceful participation in the 2022 Freedom Convoy protest in Ottawa: mischief, counselling mischief, intimidation, counselling intimidation and obstructing police. His criminal trial is scheduled for November 10, 2025. Mr. Bauder maintains that he faces political persecution by the Canadian government due to his participation in the Freedom Convoy: he has recently filed an asylum claim in the United States. Under U.S. law, if an asylum claimant returns to Canada while their U.S. asylum claim is pending, it may undermine the claim of persecution, thereby jeopardizing the asylum application. Accordingly, on August 11, 2025, TDF lawyers brought an application to adjourn Mr. Bauder's November criminal trial. The Court reserved judgment and required Mr. Bauder to attend court in person on August 27 to explain his adjournment request. At the August 27 hearing, Lawrence Greenspon suggested that Bauder was prepared to appear remotely at the day's hearing. Greenspon argued that Bauder could not attend in person because it would result in forfeiture of his pending application for asylum in the U.S. Nevertheless, Justice Phillips denied the request to adjourn the trial and issued a warrant for Bauder’s arrest. The Court stated that the trial would proceed on November 10, 2025. Speaking with the media outside the courtroom, Greenspon said: "The issue here is what would James be facing if and when he came back to Canada. We know now, as of today, the first thing he's going to be facing is an arrest warrant." Mark Joseph, litigation director for TDF, said: "We recognize that this is an extremely unusual case: Mr. Bauder has filed an asylum application in the U.S. on the basis of political persecution. While his asylum claim is proceeding, Mr. Bauder is afforded certain legal protections under international and U.S. law. Though we respect the decision of the Court, our position is that Mr. Bauder should not be forced to choose between his right to a fair trial and the viability of his U.S. asylum claim." NEWS RELEASE 🚨 Lawyer for Tamara Lich secures procedural victory in Ontario Court of Justice: Tamara Lich's lawyer appeared before the Ontario Court of Justice Tuesday seeking particulars of the alleged crimes committed by his client during the Freedom Convoy protests. The motion concluded with the prosecution agreeing to provide a full list of witnesses and evidence by August 1, 2023. The concept of particulars is similar to but distinct from disclosure. TDF's litigation director, Alan Honner, explains: "The prosecution has a duty to fully disclose all relevant evidence to the accused, but particulars need only be disclosed if a judge is satisfied that it is necessary for a fair trial." According to Honner, particulars might be ordered where a crime can be committed in different ways, where disclosure is broad, or where there are multiple co-accused. NIAGARA FALLS, ON: The Democracy Fund (TDF) has achieved a significant legal victory for a group of Amish individuals convicted under the Quarantine Act for failure to complete the ArriveCan app. Following a May 22, 2025 court appearance, seven months of negotiations and numerous court appearances, TDF lawyers successfully had the group’s convictions set aside, resulting in over $38,000 in fines being waived. The Amish community, known for their traditional lifestyle and faith-based avoidance of modern technology, faced legal challenges after crossing the border at Niagara Falls. Their inability to use smartphones or interact with modern technology made it almost impossible to comply with the strict and continually-shifting COVID-19 regulations, particularly requirements involving the ArriveCan app. TDF took the position that the Amish did not receive proper notice of the offences, trial or conviction. They were convicted in absentia, and subsequently fined over $38,000. However, with the assistance of TDF, their cases were reopened, and through persistent advocacy, the convictions were ultimately set aside with fines being waived. For these Amish families, who depend on farming and community support, the prospect of paying such excessive fines was daunting. This resolution ensures that these legal entanglements do not threaten their livelihoods and properties. TDF Litigation Director Mark Joseph stated, “This outcome is a testament to the importance of access to justice for all Canadians, regardless of their background or way of life. We are pleased that these families can now move forward without the burden of these oppressive fines. The Amish are extremely grateful for the support they've received from TDF donors.” While this case has been resolved, TDF continues to advocate for other members of the Amish community and other Canadians facing similar challenges with the legal system.
