I’ve heard ‘experts’ argue that since slaves were property, it was legal to torture or murder them as if they were firewood or mosquitos. It’s simply factually untrue, and those who abused slaves were seen as repulsive. There was a sense of noblesse oblige, as well as the law.
Murdering a slave was illegal in South Carolina!
On 5/6/1847 the Charleston Courier reported on a trial of a white woman accused of murdering her slave. It proudly stated that the law protected the slave "in the same manner as a white man, save only in the character of the evidence."
Even though Eliza Rowand was a woman, she was still prosecuted, which was an attention grabber in 1847. Though not presented below, it should be noted that Eliza's slave, Richard, was also brought to trial for murder as he was the one who administered punishment to the murdered slave on Eliza's order. Richard was found not guilty because he was only following directions. Eliza was also found not guilty, partially because there was not enough evidence to convict (arguably due to higher standards for white female defendants).
One thing is for sure: anyone who says slaves were viewed as "subhuman" is a liar or an idiot. Please take this opportunity to educate them!
