Municipal attorney for 25+ years here and I can’t wait to see how this goes! First, good on y’all! I can tell you that if this happened with one of my government clients, they would likely be furious with the contractors. Then they would likely try to negotiate compensation with the property owners. If that didn’t work, they’d go forward tomorrow with the flag men rather than trying to strong arm the property owners with bluffs about eminent domain as I’ve seen some commenters suggest. Although eminent domain can be done for temporary work, the big considerations here are start up costs and contractual penalties for delay… in addition to just compensation to the property owners. Start up costs likely outweigh the price of stopping the job and starting a months-long process and then shelling out money for lawyers, just compensation, delay fees on the contract, and returning the road to the same or better condition instead of paying a few flagmen and starting tomorrow as planned. Also, if flagmen are an option, the government may not be able to use eminent domain anyway just bc it’s more convenient for them. I look forward to an update, but I’m betting it goes forward tomorrow with flagmen and an attempt at negotiating a fair price with the property owners. But y’all are in control of that negotiation.
