We have never encouraged anyone to apply for jobs they are not qualified for however we believe that these labor market tests should be failing for most software positions given the amount of layoffs and unemployed junior engineers. Of course for some roles there may be no qualified US applicants (like foreign regulatory experience or rare language skills) in which case companies don’t have to worry. The real question is why are companies not following the law by creating explicitly hidden job boards only for their PERM jobs?

One thing to keep in mind is the Department of Labor and USCIS have never ever released the number of active H-1B and OPT visas… isn’t that curious? They released “estimates” in 2019 but it’s currently impossible to know how many active visas exist at any given moment. 🤔
